SC Warns Punjab Officials Over Dallewal’s Health Crisis

New Delhi, 28 December 2024: The Supreme Court on Saturday cautioned Punjab Chief Secretary K.A.P. Sinha and Director General of Police Gaurav Yadav, stating it may frame contempt of court charges if orders to shift farmers’ leader Jagjit Singh Dallewal to a hospital are not implemented. Dallewal, on a hunger strike since November 26, remains at the protest site, raising serious concerns about his deteriorating health.

The bench, comprising Justice Surya Kant and Justice Sudhanshu Dhulia, expressed frustration over the state’s failure to act on its directive. “Why should contempt charges not be framed against the Chief Secretary and the DGP? This is a natural progression in a contempt case,” the bench remarked, addressing the officials virtually.

Punjab AG: Protesters Blocking Action
Punjab Advocate General Gurminder Singh claimed the situation was complicated by Dallewal’s refusal to accept medical help and resistance from his supporters. “If we attempt to move him forcibly, there could be collateral damage to life and property on both sides—farmers and the police,” Singh stated.

“Conciliation is essential before any confrontation, but we feel stuck and helpless,” he added.

Justice Dhulia countered, labeling the situation “abetment to suicide,” a serious criminal issue. “A person’s life hangs in the balance, and the state machinery claims helplessness? That is unacceptable,” he said.

Call for Immediate Compliance

The Supreme Court was acting on a contempt petition filed by Mohali resident Labh Singh, alleging the Punjab government’s failure to comply with a December 20 order directing Dallewal’s medical treatment. Reiterating its concerns, the bench said, “If lawful orders face resistance, you must find ways to enforce them. This is not about disclosing strategy—it’s about saving a life.”

The court directed the state to confirm when Dallewal could be shifted to a hospital and asked whether assistance from the central government was required. The matter is set for further hearing on December 31.

Serious Health Concerns Raised
Solicitor General Tushar Mehta and Haryana’s Senior Additional Advocate General Lokesh Sinhal voiced support for hospitalizing Dallewal, underscoring the risks to his life. Dallewal has been staging his hunger strike at the Khanauri border between Punjab and Haryana, demanding the government fulfill farmers’ demands.

Protest Logistics Adding Complexity
In its December 20 directive, the Supreme Court left the choice to Punjab authorities on whether to move Dallewal to a makeshift hospital 700 meters from the protest site or take another approach. “The state government is responsible for ensuring Dallewal’s health is stable. Decisions must be made promptly to address this crisis,” the order stated.

With the court emphasizing immediate action and accountability, Punjab’s administration faces mounting pressure to act decisively before the next hearing.
