Rapist Sanjay Roy will not be hanged: RG Kar rape case sentence

Kolkata, 20 January 2025- The sentence was announced today in the RG Kar case of Kolkata, the capital of West Bengal. The court will now pronounce its verdict at 2.45 pm.

The sentence has been announced on Monday in the RG Kar case of Kolkata, the capital of West Bengal. The court pronounced its verdict at 2.45 pm and sentenced the convicted Sanjay Roy to life imprisonment. Sealdah court also imposed a fine of Rs 50,000 on Sanjay Roy. Sealdah Court Judge Anirban Das said that this is not a rarest of rare case. The victim’s family should be given Rs 10 lakh compensation for his death and an additional Rs 7 lakh.

Earlier, Sanjay Roy was convicted by a Kolkata court in the case of rape and murder of a female trainee doctor at the government RG Kar Medical College and Hospital. The sections under which Roy has been convicted carry a minimum punishment of life imprisonment, while the maximum punishment is death.

Before the verdict was pronounced, the convict was presented in the court. During this, Sanjay Roy told the court, “I am being framed, I have not committed any crime.” On this, the CBI said that this is a heinous crime. It had shaken the whole country. The CBI advocate told the court, “we request the harshest punishment to maintain the faith of the people in the society. In the case, the victim’s parents have demanded the death penalty for the convict.”

In his argument, Sanjay Roy’s lawyer said that the convict should be given some other punishment instead of hanging.

“Even if it is a rarest of rare case, there should be scope for reform. The court has to show why the convict is not worth reforming or rehabilitating. The public prosecutor has to present evidence and give reasons why the person is not worth reforming and should be completely eliminated from society,” said Sanjay Roy’s lawyer.

Additional District and Sessions Judge Anirban Das of Sealdah court on Saturday convicted Sanjay Roy of raping and murdering a postgraduate trainee female doctor in the hospital on August 9 last year. This heinous crime had sparked outrage across the country and protests continued for a long time.

Arrested on August 10, 2024

Sanjay was arrested on August 10, 2024, a day after the body of the 31-year-old doctor was found in the seminar room of RG Kar Hospital. The judge convicted him under sections 64, 66 and 103(1) of the Indian Penal Code (IPC).

Section 64 (rape) of the IPC carries a minimum sentence of 10 years, which may extend to life imprisonment. Section 66 carries a minimum sentence of 20 years, which may extend to life imprisonment. Section 103(1) (murder) of the IPC carries the death penalty or life imprisonment.

The Calcutta High Court had transferred the investigation of the case from the Kolkata Police to the Central Bureau of Investigation (CBI). The judge had said that Roy’s statement would be heard in the afternoon and the sentence would be pronounced after that.
